Welcome to Heavenly Reminiscences. By using our services, you agree to the following terms and conditions. Please read them carefully.
1. Services Provided
Heavenly Reminiscences specializes in digitizing various analog media formats, including but not limited to VHS tapes, film reels, audio cassettes, photographs, and slides. We also provide custom slideshow creation services (Memories in Motion), which include combining photos, video clips, and music into a digital slideshow tailored to the customer’s specifications.
2. Customer Responsibility
You affirm that you own the rights to the media you submit or have permission to have them digitized.
You understand that certain media may degrade over time and that Heavenly Reminiscences is not responsible for prior damage, deterioration, or loss of quality due to the age or condition of original materials.
You are responsible for securely packaging your media for shipment to avoid damage in transit.
For Memories in Motion slideshows, you confirm that you have the rights to any photos, videos, and music provided. You are responsible for obtaining necessary permissions or licenses for any copyrighted music or content included in your slideshow.
3. Media Handling and Return
We take great care in handling your media but cannot guarantee against unforeseen events such as loss or damage during shipping.
Media submitted for Memories in Motion slideshows will be used solely to create your slideshow. We will not share your media with third parties without your consent. Customers are encouraged to maintain backup copies of all submitted media.
Original materials will be returned to you unless otherwise specified.
4. Music Licensing / Usage
All music provided by Heavenly Reminiscences is licensed for personal use within your slideshow only. Clients may not redistribute or sell this music separately. If you provide your own music, you confirm that it is appropriately licensed for use in your slideshow.
Clients are responsible for ensuring their use of the slideshow complies with any platform or copyright rules. While we provide professionally synced music tracks, Heavenly Reminiscences cannot guarantee that every client will prefer the final audio-visual timing or style.
5. Turnaround Time
Estimated completion times are provided as general guidelines and may vary depending on order size, condition of materials, and current demand.
6. Pricing and Payment
Pricing is listed on our website or provided by direct estimate. All prices are subject to change without notice.
Full payment is due upon completion of the order, prior to shipment or pickup of digitized materials, unless otherwise agreed in writing.
7. Refund Policy
Due to the personalized nature of our work, all sales are final. Refunds may be considered in cases of incomplete or unsatisfactory service at our sole discretion. For details, please see our Refund Policy.
8. Limitation of Liability
In no event shall Heavenly Reminiscences be liable for any indirect, incidental, or consequential damages. If liability is established, it shall not exceed the total cost paid by the customer for the specific order.
9. Privacy
We respect your privacy. Personal information provided will be used only to complete your order and communicate with you about services. We do not sell or share your information with third parties.
10. Intellectual Property and Copyright
By submitting media for digitization or slideshow creation, you confirm that you are the rightful owner of the content or have obtained all necessary permissions from the copyright holder to duplicate, convert, or use the material. Clients retain full ownership of their original media and any digital versions we create. We reserve the right to refuse any order that we reasonably believe may violate copyright law.
For Memories in Motion, you grant Heavenly Reminiscences a limited license to use submitted media solely for creating your slideshow.
11. Digital File Storage
Files submitted for digitization or Memories in Motion slideshows may be stored using secure, industry-standard cloud services, including Amazon Web Services (AWS) and FileCloud. These services are used solely for the secure storage and management of your media files during processing and delivery. We make every reasonable effort to safeguard your data, but we cannot guarantee absolute security. We do not retain permanent copies without client consent.
12. Changes to Terms
Heavenly Reminiscences reserves the right to modify these terms at any time. Updates will be posted on our website.
